These rules regulate the terms of the “”Out of bounds in the Fortnite creative island game competition ” (hereinafter referred to as “Contest”) and are the only document which regulates completely and obligatorily the rules of this contest.
The host of the Contest is Škoda Auto a.s., a joint-stock company with its registered office at tř. Václava Klementa 869, 293 01 Mladá Boleslav, Czech Republic, Company ID number 00177041, registered in the Commercial Register administered by the Municipal Court in Prague, section B, file number 332 (hereinafter referred to as the “Host”).
The Contest is a special one-time event announced in connection with the launch of the Škoda Fortnite Creative Island.
The Ccontest period will start on the 7th of December 2023 and end 28th December 2023. Entries received outside of this period will not be eligible for participation.
The Contest may be entered by any individual who has reached at least the age of 18, and who resides in one of the countries where the Contest is being held. On ad hoc basis we may, at our sole discretion, allow minors to participate, should we see fit, especially if the participant is to turn 18 during course of the competition or shortly thereafter . The Contest is being held in the following countries: Czech Republic and Great Britain.
To enter the Contest it is necessary to participate and fulfil all requirements anytime during the Contest period, and confirm unconditional acceptance of these rules.
Each participant can register himself/herself to the game via taking a selfie at the selfie station, using his/her phone or screenshot the image and post it to Instagram tagging @skodagram.
All persons who have participated in the preparation of this Contest, mainly persons employed by or in a similar relationship with the Host, are ineligible to participate in the Contest, as are any persons in a similar relationship with the participating authorised Škoda partner or with agencies entrusted with ensuring this Contest, their family members and persons close to them.
To enter the Contest, the entrant must fulfil all the following requirements:
Only one entry per person is permitted. Multiple entries from the same person will be disqualified. Attempts at winning via employing unfair practices (such a submitting screenshots from accounts that do not belong to the person, submitting a photo from the wrong part of the map, or re-submitting entries from other players) are also forbidden and will result in disqualification.
The Host may also disqualify you if we learn that you don’t comply with these terms or you have otherwise violated the dignity of the competition or grossly breached the license conditions or otherwise behaved contrary to good morals and thereby brought the event, its competition manager, or Epic Games, Inc. into disrepute. If we disqualify you, we reserve the right to claim the already provided prize back or, where appropriate, reasonable damages.
The winners will be selected randomly from the list of eligible entrants who have fulfilled all the requirements. The selection process will be overseen by Škoda or its appointed representatives.
The winner will be contacted directly via Instagram direct message (DM) to organize the delivery of the prize. If the winner does not respond within seven days of being notified, Škoda reserves the right to select an alternative winner.
The winner's name may be announced on @skodagram and Instagram account and may also be used for promotional purposes.
Škoda will select up to 20 winners for the competition. Winners will receive redemption codes for 20 000 V-Bucks. The prize is non-transferable, and no cash or other alternatives will be offered.
If a participant becomes a winner, he/she grants a consent to the Host to obtain and use participant’s portraits, written statements, photos and audio and visual recordings related to the participant and/or expressions of a personal nature obtained by the Host in connection with the hosting of the Contest and the delivery or drawing of winnings for commercial purposes in all communication media, regardless of their character and specifications, using all typical means, with their subsequent modification and with potential combination with other works and inclusion into a collective work. The participant grants the Host this consent free of charge without material, time, quantity or territorial limitations and can revoke it at any time. This consent shall also apply to third parties to whom the Host may provide such recordings at the Host's own discretion.
The Host, as a personal data controller according to General Data Protection Regulation (Regulation (EU) 2016/679), hereby provides you with information about the processing of personal data and your rights related to the processing.

Organisation of competitions and assurance of fair voting in a voting competition
Legal basis of the processing:
We are entitled to process your personal data on the basis of the conclusion of a contract (these Contest Rules).

Identification data, Contact information, Information on mutual communication and interaction.
Processing period:
We process your personal data one year after termination of the Competition.

Upon request, your personal data may be provided to public authorities, in particular courts, the Police of the Czech Republic and other law enforcement authorities to the extent necessary and within the limits of the law.

We receive the personal data directly from you.
Transfer of personal data to third countries or multinational companies:
As part of this processing, your personal data will not be transferred to third countries or multinational companies.
Automated decision-making based on personal data:
During this personal data processing, automated decision-making based on the personal data does not occur.

Personal data may be archived in the public interest and used for scientific, historical or statistical research purposes. In well-founded cases, personal data can also be the subject of processing for the purposes of legal matters resolution, including the performance of obligations towards public administration bodies and monitoring and ongoing evaluation of legal risks.

In connection with the exercise of your rights, Škoda Auto may charge a reasonable fee taking into account the administrative costs for the processing when requests from a data subject are apparently unfounded or excessive.

If you do not agree with the way we process your personal data, you can file a complaint with Škoda Auto's Data Protection Officer or file a complaint with the supervisory authority to protect your rights.
The Host shall exclusively determine the exact specifications of the winnings. The displaying of winnings in promotional materials is illustrative. The Host shall not be liable for any damages caused to the participant as a result of using the prize.
The participants are not entitled to demand money or other types of fulfilment as a substitution for the prize. The Host is not otherwise hereby bound to provide fulfilment to the Contest participants, and the participants shall not be entitled to any fulfilment from the Host other than that expressly specified herein.
The Host isn’t responsible for the quality of prizes delivered by third parties. It is necessary to exercise responsibility for possible defects directly at these suppliers. The Host reserves the right to change prizes at their own discretion.
A participant may be excluded from the Contest if the Host discovers or has reasonable suspicion that the participant or other persons aiding the participant have engaged in fraud in order to receive prizes or engaged in unfair conduct or conduct not based on the participant’s knowledge in accordance with the rules.
The Host shall not be liable for any failure to deliver messages or winnings. The Host shall not be liable for any mistake occurring as a result of technical or communication problems. The Host shall decide with final validity regarding any complaints or presented objections. The Host reserves the right without being required to provide compensation to shorten, postpone, suspend or cancel the event and the prizes or to change or add anything to these rules unilaterally during the event’s existence by notifying of such changes on the website specified above, where the valid and complete wording of the rules can also be found.
This Contest is not in any way operated, sponsored by or associated with Instagram or Epic Games, Inc. and Instagram nor Epic Games, Inc. is not responsible for it. The information provided during the event will not be provided to Facebook Instagram or Epic Games, Inc.. All questions, comments or complaints regarding the application must be directed to the Host.
To the extent permitted by applicable law, participants agree to release and hold harmless Epic Games, Inc., its licensors, its and their affiliates, and its and their employees, officers, directors, agents, contractors, and other representatives from all claims, demands, actions, losses, liabilities, and expenses related to this Contest.
This Contest is governed by the laws of the Czech Republic, except to the extent excluded by the applicable legislation of the participants’ countries.
