ŠKODA Connect services are also accessible via Google Home, i.e. cloud-based voice service available on devices from Google LLC and/or their affiliates (“Google”) and third-party device manufacturers (“Google Home-enabled device”, such as the Google Home or Google Home Mini), using specific Action applet developed for ŠKODA AUTO (the “Action”).
These Terms of Use (the “ToU”) are an agreement (the “Agreement”) between you and ŠKODA AUTO a. s. (“ŠKODA AUTO”, or “us”, or “we”). The ToU govern your use of the ŠKODA Connect services on Google Home-enabled devices, i.e. the ”Action”. This agreement applies in addition to any other policy contract or agreement that you may have with ŠKODA AUTO.
Before using the Action, please review these ToU, as well as the other ŠKODA AUTO legal documents related to ŠKODA Connect. All legal documents as amended are accessible via ŠKODA Connect Portal. If you do not agree to this Agreement in its entirety, then you may not use the Action.
To use the Action, you must (1) be a ŠKODA Connect customer; (2) have an active ŠKODA Connect account that must be connected to the Action; (3) be over the age of 18; (4) have an Google Home-enabled device, (5) have an internet connection, and (6) have an active Google Home account. Using the Action also requires that (1) the ŠKODA Connect services (Care Connect) in your ŠKODA vehicle are activated; (2) Privacy mode is not turned on; (3) your ŠKODA vehicle is able to go online (connectable).
If any of these requirements do not apply to you, do not use the Action. By using the Action on the Google Home-enabled device, you agree to the ToU, separate terms and conditions of the Google Home-enabled device and also to the Google Home Terms of Use as amended. These should be read in conjunction with the other ŠKODA AUTO and Google legal documents such as privacy and cookie policies as amended. ŠKODA legal documents are accessible via ŠKODA Connect Portal. Google legal documents are available via Google Home web sites. You shall not use the Action via Google Home if you do not agree to all these above mentioned terms and conditions of ŠKODA AUTO and Google.
In order to use the Action you will need to download the Action via a smartphone application (the “Google Home App”). ŠKODA AUTO accepts no liability for any damage to your or any other person’s computer or device relating to or resulting from using the Action or downloading the App.
The Action allows you to receive information from and access to ŠKODA Connect by using your Google Home-enabled device. Using the Action consists of you speaking commands and questions aloud to your Google Home-enabled device, and then receiving responses from us through your Google Home-enabled device. When you use the Action, Google relays your queries to ŠKODA Connect, retrieves requested information and presents it to you. Any questions and commands given via Google Home will be treated as authorized by you. Any response Google Home provides will be given as authorized by you to do so. The services of Google Home are performed and controlled by Google, who, in order to provide and improve their services, may record and keep data on your interactions with Google Home and/or the Action. By accepting this Agreement, you understand and agree that Google may perform said actions in order to provide and improve their services. Depending on the security settings of your Google Home-enabled device, it may be possible for you to allow other users’ access to the Action. By allowing other users to access and/or use the Action, you assume all liability and responsibility for how the Action and/or any information obtained from the Action are accessed and/or used. ŠKODA AUTO will not be liable for any use of the Action by users you have (or have not) authorized to have access to Google Home and to the Action.
By using the Action you declare you are aware and agree that the relevant data are provided to Google for the purpose of providing ŠKODA Connect via Google Home. When asking Google Home for information, it will be retrieving this information for you and you agree to Google performing this. Google may also record your interactions with the Action or with Google Home and shall handle the personal data concerned in accordance with Google Home Privacy Notice and other relevant legal documents, which you have already confirmed when creating your Google Home Account.
ŠKODA AUTO does not design or manufacture Google Home and/or your Google Home-enabled device and has no control over them. It is possible that Google Home may not hear you properly, may misinterpret what you say, or may say something to you that is different from the information that ŠKODA AUTO provided to Google Home in response to your question. ŠKODA AUTO therefore accepts no responsibility for any damage, loss, liabilities or injury incurred or suffered by you or by third parties as a result of using the Action, including as a result of ŠKODA AUTO providing inaccurate, untimely, incomplete or erroneous information.
ŠKODA AUTO shall not be responsible for any costs associated with using the Action including the purchase and use of a Google Home-enabled device or the internet connection.
ŠKODA AUTO reserves the right to modify or discontinue the Action at any time without prior notice. The number and range of services offered via Google Home may change over time and depend on Google's current offer and availability. ŠKODA AUTO provides you solely with access to information.
ŠKODA AUTO reserves the right to amend these ToU from time to time. The latest version of ToU shall be always available on ŠKODA AUTO website. Any amendments shall become part of the these ToU if you have received an email notifying you of these amendments at least two (2) weeks before they are due to take effect. If you continue using the Action after the amendments have taken effect, we will assume that you agree with the amendments and they shall become effective for you. Should you object to the amendments, the amendments shall not be effective for you and as a result you shall not be entitled to use the Action anymore.
The Action is available on the territory of Europe, except for the territory of Finland, Croatia, Switzerland and Romania. You may download, access and use the Action freely and in all locations considering the before mentioned limitation, however availability of native-language versions for the Action as well as customer support from the local ŠKODA AUTO importers may be restricted or not provided at all.
ŠKODA AUTO may terminate your access to the Action at any time and without notice if you fail to comply with any of terms herein. ŠKODA AUTO may also terminate your access to the Action if the Action is no longer available.
ŠKODA AUTO accepts no responsibility and liability for any damage, loss, injury or disappointment incurred or suffered by you as a result of using the Action, including as a result of us and/or our partners providing inaccurate, untimely, incomplete or erroneous information. ŠKODA AUTO shall not be liable for any failure to comply with its obligations where the failure is caused by something outside its reasonable control.
The abovementioned limitations shall not exclude our liability for our own or through our legal representatives or vicarious agents caused damage resulting from injury to the user's life, body or health as well as for our own or by our legal representatives or vicarious agents intentionally or grossly negligent caused any other damages as well as for damages resulting from the violation of mandatory provisions of the relevant legislation.
For legal disputes arising out of or in connection with these ToU or use the content is subject to the laws of Czechia with the exception of its conflict of law principles. If the user is a merchant, legal entity under public law or special fund under public law, is exclusive jurisdiction for all disputes arising out of or in connection with these ToU Mlada Boleslav, Czechia, agreed.
